A LICITUDE DA ORTOTANÁSIA SOB A ÓTICA DO ORDENAMENTO JURÍDICO BRASILEIRO E A VALIDADE JURÍDICA DAS DIRETIVAS ANTECIPADAS DO PACIENTE
Abstract
O presente artigo tem o escopo de analisar, em primeira instância, a licitude da Ortotanásia à luz da Constituição Federal de 1988, analisando-a sobre a ótica de princípios como o da Dignidade Humana e Autonomia. Recentemente, no Brasil, entendimentos mais precisos à cerca do tema vem se desenvolvendo e propiciando a elaboração de normas que regulamentam a prática da ortotanásia e introduzindo o instrumento das Diretivas Antecipadas. Das normas já vigentes serão analisadas em especial às Resoluções nº 1.805/2006 e nº 1.995/2012, ambas do Conselho Nacional de Medicina, o Novo Código de Ética Médica. Também abordaremos a questão do anteprojeto do novo Código Penal Brasileiro, que traz em sua proposta de reforma a excludente de ilicitude, no que se refere a ortotanásia. Em segunda instância serão abordados aspectos referentes ao instrumento jurídico conhecidos como Diretivas Antecipadas do Paciente ou também Declaração Prévia de Vontade e Testamento Vital. O referido instrumento tem o propósito de garantir o cumprimento das vontades da pessoa quando, de alguma forma, esta não for capaz de expressa-las, valendo-se, em especial, do princípio da autonomia da vontade. Assim, o paciente poderá dispor antecipadamente sobre quais tratamentos deseja ser ou não submetido.Downloads
