O ATIVISMO JUDICIAL, A JUDICIALIZAÇÃO DE POLÍTICAS PÚBLICAS E O DIREITO À SAÚDE

Abstract

O presente artigo científio abordará a forte tendência interventiva do Poder Judicial
ou Judiciário sobre a atuação típica dos demais Poderes, especifiamente focado na
temática da inaplicabilidade dos direitos sociais. Com este escopo, iremos tentar
responder a alguns questionamentos relacionados à legitimidade desta atuação judicial
atípica, e a possibilidade de transbordamento e violação aos princípios democráticos.
Assim, a proposta do presente estudo é entender o mencionado fenômeno jurídico,
visualizar situações práticas e tentar balizar a aplicação do instituto com base na
doutrina de Ronald Dworkin, de forma a evitar que o Poder Judiciário abuse desta
prerrogativa.

ABSTRACT

The following scientifi article approaches the strong interventional tendency
of Judicial Branch or Judiciary over the other Powers, specifially focused on the
inapplicability of the social rights. With this scope, we will try to answer some
questions related to the legitimacy of this atypical judicial action, and the possibility
of overflw and violation of democratic principles. Thus, the purpose of the present
study is to understand the aforementioned legal phenomenon, to visualize practical
situations and try to demarcate the application of the institute based on the doctrine of
Ronald Dworkin, in order to avoid that the Judiciary Abuses this prerogative.
