In cammino verso la giustizia non violenta

Il saggio analizza il percorso di Paul Ricoeur intorno alla giustizia, cogliendone il cammino che inizia dalle criticità (Ricoeur parla di fallimenti) dell’ordine giuridico inteso come diritto positivo impotente nel giustificare in maniera convincente il “diritto di punire”. Nella tessitura ricoeuriana irrompono altri concetti che tentano una mediazione come amore, perdono per disegnare una circolarità di etica e politica. Lo scopo è il disegno di una giustizia ricostruttiva o restauratrice, giustizia non violenta che ristabilisca il legame sociale infranto dall’azione criminosa, e offra riparazione contemporaneamente alla legge, alla vittima e al condannato.
