O artigo caracteriza-se como estudo teórico a cerca das possibilidades de aproximação dos instrumentos conceituais da análise da biologia cerebral animal por Maturana e Varela (2005), para compreensão epistemológica do discurso do Direito a partir do grande valor do argumento de autoridade. Examinam-se os conceitos de “ponto cego”, de hermenêutica e de legitimidade acadêmica do conhecimento científico. As cogitações estão embasadas na literatura foram complementadas por contagens de frequências, a partir de programas de Pós-Graduação, considerados centros de excelência nacional na pesquisa jurídica.
