Abstract

The result of a master's thesis presented to the Universidade Federal Fluminense, this article aims to analyze the right to health of pregnant, postpartum and lactating women inserted in the prisons of the State of Rio de Janeiro. Bearing in mind that the female prison population has increased by 656% in 16 years, it is essential to ascertain whether the penal environment is capable of receiving this portion of the population. The research was developed through bibliographical and documentary research, using international legislation such as the Bangkok Rules to confront the norm with the reality described in scientific articles that have empirical research as a methodology. However, the results presented show that there is a lot of norms for little right, that is, despite the vast amount of internal and external norms that protect the prisoner woman who is pregnant, breastfeeding or has given birth, in reality the mechanisms are not actually present in the current situation, generating as a consequence for these women and their children, in addition to damage to physical health, mental wear, with the imminent feeling of losing their offspring.
